Il existe des lois f\u00e9d\u00e9rales, des lois et codes provinciaux et des d\u00e9cisions de la Cour supr\u00eame pour prot\u00e9ger les droits des personnes handicap\u00e9es\u207d\u00b9\u207e.<\/p>\n<p>La Loi canadienne sur les droits de la personne interdit la pratique discriminatoire de refuser d\u2019embaucher quelqu\u2019un ou de la traiter diff\u00e9remment en raison d\u2019un handicap. Elle interdit \u00e9galement les demandes d\u2019emploi qui expriment ou impliquent une limitation. Les employ\u00e9s ne sont pas autoris\u00e9s \u00e0 harceler leurs coll\u00e8gues en raison de leur handicap en vertu de cette loi. La Loi canadienne sur les droits de la personne interdit la discrimination lorsque des Canadiens sont employ\u00e9s ou re\u00e7oivent des services du gouvernement f\u00e9d\u00e9ral, des gouvernements des Premi\u00e8res nations et des entreprises priv\u00e9es qui sont r\u00e9glement\u00e9es par le gouvernement f\u00e9d\u00e9ral comme les banques, les entreprises de camionnage, les radiodiffuseurs et les entreprises de t\u00e9l\u00e9communications.<\/p>\n<p>La loi sur l\u2019\u00e9quit\u00e9 en mati\u00e8re d\u2019emploi vise \u00e0 \u00ab parvenir \u00e0 l\u2019\u00e9galit\u00e9 en milieu de travail de fa\u00e7on que nul ne se voie refuser d\u2019avantages ou de chances en mati\u00e8re d\u2019emploi pour des motifs \u00e9trangers \u00e0 sa comp\u00e9tence \u00bb. \u207d\u00b2\u207e La loi stipule que l\u2019\u00e9quit\u00e9 en mati\u00e8re d\u2019emploi va au-del\u00e0 du traitement des gens de la m\u00eame mani\u00e8re (\u00e9galit\u00e9) mais n\u00e9cessite \u00e9galement des mesures et des accommodements sp\u00e9ciaux. Cette loi vise \u00e0 corriger les d\u00e9savantages subis par les femmes, les autochtones, les personnes handicap\u00e9es et les membres de minorit\u00e9s visibles. La loi s\u2019applique aux employeurs du secteur priv\u00e9 et \u00e0 tous les secteurs de l\u2019administration publique f\u00e9d\u00e9rale employant au moins cent salari\u00e9s, y compris la GRC et By having an open conversation, you may be able to work together in order to determine what will work best for you.\u00a0<\/p><p>[\/et_pb_text][et_pb_text _builder_version=\"4.17.4\" _module_preset=\"default\" global_colors_info=\"{}\"]<\/p><p><strong>2.\u00a0<\/strong> Have a discussion with your healthcare provider about your occupation and how your disease may impact it. Your healthcare provider may be able to give you tips about possible accommodations in your workplace.\u00a0\u00a0<\/p><p>[\/et_pb_text][et_pb_text _builder_version=\"4.17.4\" _module_preset=\"default\" global_colors_info=\"{}\"]<\/p><p><strong>3.\u00a0 <\/strong>Meet with an occupational therapist who can help you optimize your surroundings based on your condition. Sometimes you may be able to request this assessment via your employer.\u00a0<\/p><p>[\/et_pb_text][et_pb_text _builder_version=\"4.17.4\" _module_preset=\"default\" global_colors_info=\"{}\"]<\/p><p><strong>4.\u00a0 \u00a0<\/strong>There are many accommodation options that exist, so exploring them and figuring out what you need is important.\u00a0<\/p><p>Flexibility in scheduling can be beneficial by allowing you to work part time or work from home when needed. The option to set your own hours can also allow you to work during the hours when you feel best.<\/p><p>Depending on your job, you may want to look into modifying your duties. For example, if you\u2019re a nurse who is struggling with the physical demands of the job, inquire if you can change to mostly administrative duties, while remaining in the nursing field. Some employers offer to pay for re-training or education should you need to change your role (i.e. working on a production line then moving into an office job.)<\/p><p>You may also find relief in using ergonomic devices. There are federal statutes, provincial acts and codes and Supreme Court decisions to protect disability rights \u207d\u00b9\u207e.<\/p><p>The Canadian Human Rights Act prohibits the discriminatory practice of refusing to employ someone or treating them differently due to a disability. It also prohibits employment applications that express or imply limitation. Employees are not allowed to harass their colleagues based on their disability under this act. The Canadian Human Rights Act bans discrimination when Canadians are employed by or receive services from the federal government, First Nations governments and private companies that are regulation by the federal government like banks, trucking companies, broadcasters and telecommunications companies.<\/p><p>The Employment Equity Act aims to \u201cachieve equality in the workplace so that no person shall be denied employment opportunities or benefits for reasons unrelated to ability.\u201d\u207d\u00b2\u207e.The act states that employment equity goes beyond treating people the same way (equality) but also requires special measures and accommodations. This act aims to correct the disadvantage experienced by women, aboriginal peoples, persons with disabilities and members of visible minorities.
